How New York car accident claims work

New York is a no-fault state. Your own auto policy pays your medical bills and part of your lost wages up to the policy limit, no matter who caused the crash. You generally must file the no-fault application within 30 days of the accident, so don't wait.

To sue the at-fault driver for pain and suffering, your injury must meet New York's serious injury threshold under Insurance Law §5102(d). Fractures, significant disfigurement, permanent loss or limitation of a body part, and injuries that keep you from normal activities for 90 of the first 180 days can qualify.
