What we handle
New York courts have made it clear that an injured worker's immigration status is not a defense. In Balbuena v. IDR Realty (2006), New York's highest court held that undocumented workers can recover lost wages in personal injury cases. You have the same right as any other worker to recover medical bills, lost earnings, and pain and suffering.
Every conversation is confidential. We will never ask about, share or report your status. Consultations are available in Spanish. Se habla español.
Your rights after a work injury
- Full recovery under Labor Law §240(1) for falls from scaffolds, ladders and roofs, and for falling objects
- Claims under Labor Law §241(6) when Industrial Code safety rules are broken
- Workers' compensation benefits, which do not depend on immigration status
- Third-party lawsuits against property owners, general contractors and equipment makers
Why immigrant workers face more risk
Immigrant and Hispanic workers make up a large share of New York's construction labor force. They are often assigned the most dangerous jobs with the least training and equipment. Evan Goldberg serves on the board of SOMOS New York and has spoken publicly about these risks.
We handle construction accidents and other workplace accidents. Watch Evan discuss undocumented immigrants' construction rights and Hispanic and African-American workers at risk, or visit nuestro sitio en español.
