I’m Evan Goldberg, President Elect of the New York State Trial Lawyers Association. I’m here with my friend, Abraham Lincoln, in front of the New York Historical Society on Central Park West in Manhattan. Lincoln was one of the greatest trial lawyers of his age. So it’s only fitting that NYSTLA is having its annual installation of officers and directors here on June 23rd, 2015. On that date, the Chief Judge of the State of New York, the Honorable Jonathan Lippman will be administering the oath of office. It promises to be a festive evening of camaraderie, cocktails, and celebration.  We sincerely hope you can make it.

With training, you have to be careful not to shift the responsibility for providing a safe work site onto a worker who is unsophisticated or uneducated. So it’s easy to say when an accident occurs that, well, the worker wasn’t being careful or he wasn’t trained properly. But in fact, there’s an overriding responsibility of the owner, the general contractor, the construction manager, to make sure that the work site itself is safe. Listen, the construction industry has been in existence for a very, very long time. It’s a learned industry full of engineers. People go to school for this. People have degrees and all the sorts of issues that arise on a construction site. The concept that accidents just happen has no place on a well-run legally compliant work site. It just has no place because we hold construction managers and owners and general contractors and contractors on jobs to the standard of prioritizing safety over profit. But unfortunately, many times we see that just the reverse takes place.

There are real people. You know, people take the, the ceilings above their heads and the ground underneath their feet for granted. But there are real people building those things who were up there at obscene heights, putting their lives in danger, putting the livelihood of their families in danger, and they deserve the proper protections that they’ve enjoyed throughout these years. So the overriding principle is to leave it alone. The law works, the law makes sense, and the law has served American families, New York families very well over these years. And the court system is well able to deal with any isolated claims of abuse or misapplication of the law. Trust the judges also, that’s what I would say Chairman Bronson.

Speaker 1:  So why did you become a lawyer? Well,

Speaker 2: Well, as a third generation lawyer, my grandfather was a lawyer in the great depression and my father was a Supreme court justice in New York state, many assumed I would just be steered towards the law because of my family, but it was really more that I developed a love of the law.  When I was a teenager, I would watch movies such as “To kill a Mockingbird.” And I would observe the history of leaders who fought for justice and societal equality. And I saw.  I saw early on, the important role of the trial lawyer in advocating for justice and equality among all. And it’s something that I chose to dedicate my life towards and I’ve never looked back.  And, you know, my father approved of course.

Speaker 1: And why did you assume the presidency of the New York State Trial Lawyers Association?

Speaker 2: Well, as I said, our mission is to promote a safer and healthier society. It’s something I deeply believe in.  Lawyers have had a very important role over the years in making sure that negligent conduct is addressed and corrected. Many of the safety initiatives that we take for granted are there because lawyers stood up for the little guy and lawyers made a difference, and that’s something that I’ve always wanted to do.  When I’m in the courtroom, when I’m fighting for a client’s case, it’s a microcosm of America to me, where all thoughtful discourse is entertained, the truth is sought and justice is done.

We’ve seen the Trial Lawyers Association doing a lot of work to end distracted driving. Could you explain that? Well, one of our colleagues, Joel Feldman from Philadelphia, he lost his daughter tragically in a motor vehicle accident when the driver was driving while texting, it’s a story that we see all too often these days and distracted driving, of course, isn’t just texting. It could be eating a sandwich, it could be fiddling with the radio. It could be doing anything at all. As trial lawyers we see the effects of this. We have a unique responsibility to share what we learn. We see the effects of this in our waiting rooms and in the courtrooms, we see lives turned upside down through distracted driving, and we think it’s our responsibility to go into the communities; we’re going into the high schools. And we’re trying to get people to really understand the increased risks that go along with distracted driving and hopefully have the dialogue make a difference.

Injuries from elevation related hazards are among the most prevalent in the construction industry and have the greatest effect on workers. They have the potential to cause the greatest harm when people fall from great heights or when objects fall upon them. The labor law, the scaffold safety law, which is what I believe you’re referring to, has protected workers who have been working at heights for over a hundred years in New York and New York, by comparison has enjoyed, one of the best safety records in construction in the country. And even with that, it’s still staggering, the amount of accidents that exist. So those who would seek to repeal the law are misguided because there is absolutely no reason to take away the safeguards that we have in place that have facilitated the construction of this city, of this state, all the buildings that you see around you were erected with the protections of the scaffold law in place.

And the only reasons being proffered to take away the protections to workers are because, insurance costs too high, but they don’t prove it. They don’t prove it at all. And in fact, the insurance industry, the carriers are reporting record profits, record profits. So there’s no justification there. Another thing we heard in recent years was that construction is stagnated.  Well, construction is booming. Look around.  Everywhere throughout the state, construction is seeing a surge and it’s cyclical. It goes through ups and downs and ups and downs over the last a hundred plus years, all with the labor law in place, all with New York valuing the safety and well being of the New York worker and his or her family. That’s something that should never, ever change.

So we’ve heard a lot about Lavern’s law and the famous case of a woman from Brooklyn who died because her hospital never told her she had cancer. Can you explain what this law would do? Well, there are hundreds of thousands of victims of medical malpractice who die every year through preventable medical errors and Laverne Wilkinson was one of those people. She died because her doctors forgot to tell her that she had cancer. And when they did tell her she had cancer, it was too late to treat the cancer. But even more than that, it was also too late for her to even have a lawsuit. Strangely enough, her statute of limitations started to run before she knew she had cancer. And by the time she found out it had already expired. She has, she had three children, one of whom had special needs and requires lifelong care. And that case was over before it started. So the unfairness of that is self-evident. Most states, 44 States across the country have statutes of limitation starting from the date of discovery of the malpractice, rather than from the date of the treatment itself. And that makes sense. And Laverne’s law would seek to bring us up to those other States and what they’re doing.

There’s now a movement to try and do away with jury trials. Mandatory, forced arbitration is a big issue these days. People don’t know that they’re signing away their rights to a jury trial every time they click an app, every time they send in a coupon for a breakfast cereal, anytime they click on, “I agree” at the bottom of an internet Verizon screen, and it’s a very disturbing trend. In fact, there’s a woman who broke a hip in a nursing home and her case was not allowed to go to a jury trial because of the nursing home admission agreement that said that you have to go to arbitration and arbitration is nowhere near as transparent as a jury trial, it’s not going to give you this chance at justice and equal access to the courts as a jury trial. And it’s a trend that’s very dangerous.

How many undocumented workers?  As you know, Chairman Moya, they’re picked up, as day laborers on the site. I’ve told this story on a panel with you just a couple of months ago, how a worker that I represented comes to my office with a few missing fingers. And II asked him, where were you working? He had no idea. Who were you working for. He had no idea.  Give me some information. He gave me nothing. I had to hire a private investigator to find out where he was working, so that I could bring a lawsuit. They picked him up on the street. They didn’t even want to take him to the hospital. They wanted to disavow any relationship with him whatsoever. So it’s not only that they’re exposed to more hazards by virtue of being untrained and placed in the type of hazardous jobs that union workers would not be subjected to, but once an accident happens, they’re victimized yet again, by not being able to avail themselves of the safeguards under the law, by bringing an action because people want to forget they ever existed.
